EU public consultation on territorial supply restrictions

These restrictions prevent purchasing products in one Member State and reselling them in another, limiting consumer options and causing price differences

The European Commission has launched a public consultation to gather the opinions of stakeholders and citizens on the proposed measures to address territorial supply restrictions.

Territorial supply restrictions are practices applied by certain large manufacturers that prevent retailers or wholesalers from acquiring products in one Member State and reselling them in another. These practices can limit consumer choices and contribute to significant differences in the prices of everyday consumer goods across the EU.

Retail and wholesale territorial supply restrictions are included in the list of the ‘terrible ten’, that is, the ten most harmful obstacles to the single market, according to the Single Market Strategy adopted in May 2025. The Commission has committed to develop tools to address unjustified territorial supply restrictions in cases that fall outside the scope of competition law.

The consultation invites retailers, wholesalers, manufacturers, public authorities, consumers, civil society organizations, and the academic world to share their views and experiences through the portal ‘Tell us what you think’.

The contributions will be incorporated into the ongoing impact assessment and will be taken into account when defining the options for action. They will complement the inputs gathered in the data call that took place between March 5 and April 24.

The public consultation is initially published only in English and will remain open for a period of 12 weeks. It will soon also be available in other languages. The 12-week consultation period will resume once all EU language versions are available.
